1. Acceptance

These Terms of Service (“Terms”) govern your access to and use of okuleypharmacy.com (the “Site”), operated by Okuley's Pharmacy Inc. (“Okuley's Pharmacy,” “we,” “us,” or “our”). By accessing the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Informational Purpose Only

The Site provides general information about our pharmacy, our services, and health-related topics. Content on this Site is not medical or pharmaceutical advice. It is not a substitute for consultation with your physician, pharmacist, or other qualified healthcare professional.

Never disregard professional medical advice or delay seeking it because of something you read on this Site. If you are experiencing a medical emergency, call 911 immediately.

3. No Professional Relationship

Using this Site does not create a pharmacist-patient relationship, a physician-patient relationship, or any other professional relationship between you and Okuley's Pharmacy or its personnel. A pharmacist-patient relationship is established only when we accept and process a valid prescription for you.

4. Prescriptions and Compounded Preparations

Valid prescription required. All prescription medications, including compounded preparations, require a valid prescription from a licensed prescriber authorized to prescribe in the applicable jurisdiction.

Compounded preparations.Okuley's Pharmacy compounds medications pursuant to Section 503A of the Federal Food, Drug, and Cosmetic Act. Compounded preparations:

• Are not approved by the U.S. Food and Drug Administration
• Have not been evaluated by the FDA for safety, effectiveness, or manufacturing quality
• Are prepared only pursuant to a valid patient-specific prescription
• Are not intended to be copies of commercially available drug products

Nothing on this Site should be read as advertising or promoting the compounding of any particular drug, class of drug, or type of preparation. Descriptions of our compounding capabilities are provided for general informational purposes to patients and prescribers.

Pharmacist discretion. Submitting a prescription or request does not guarantee it will be filled. Our pharmacists exercise independent professional judgment and their corresponding responsibility under state and federal law, and may decline to fill any prescription.

Individual results vary. Any outcomes described on this Site are illustrative and do not guarantee results for any individual.

5. Licensure and Geographic Scope

Okuley's Pharmacy is licensed by the Ohio State Board of Pharmacy. Our services are offered in accordance with Ohio law and the regulations of the Ohio State Board of Pharmacy. 6. Third-Party Services and Links

The Site links to services operated by third parties, including forms and scheduling tools hosted on third-party platforms. We do not control those services and are not responsible for their content, availability, or practices. Links do not constitute endorsement.

Message frequency varies. Reply STOP to unsubscribe or HELP for assistance. Consent to receive text messages is not a condition of purchase or of receiving pharmacy services. Carriers are not liable for delayed or undelivered messages.

10. Disclaimer of Warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. Nothing in these Terms limits or excludes liability arising from the professional pharmacy services we provide to you, or any liability that cannot lawfully be limited or excluded.

12. Indemnification

You agree to indemnify and hold harmless Okuley's Pharmacy from any claims, damages, or expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Site.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Ohio without regard to its conflict of laws principles. Any dispute arising from these Terms or the Site shall be brought exclusively in the state or federal courts located in or serving Defiance County, Ohio, and you consent to their jurisdiction.

14. Changes to These Terms

We may modify these Terms at any time. Changes are effective when posted, as reflected in the “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance.

15. Severability
